Any business in Connecticut with at least one employee has to carry workers’ compensation insurance. This includes car washes and their full-time, part-time, and seasonal employees, and the insurance has to begin no later than the employee’s first day. Where car wash owners may find some savings in their premium is in properly classifying their workers, tracking seasonal payroll, and having a complete safety program.

What Connecticut Workers’ Comp Law Requires of Car Wash Employers

Connecticut’s Workers’ Compensation Act, codified at Chapter 568 of the Connecticut General Statutes, applies to any employer with one or more employees. There is no guaranteed threshold based on payroll size, hours worked, or number of locations. A car wash with a single attendant carries the same workers’ compensation coverage obligation as an operation running five bays across three towns.

Coverage must be active from the employee’s first day, and paperwork cannot be filed after the fact and dated retroactively. An employer operating without coverage can face a stop-work order as well as civil, criminal, and financial penalties under Connecticut General Statutes Chapter 568 Section 31-288.

This reflects the general enforcement structure under state law. A car wash owner facing an active compliance question or investigation should confirm specifics with legal counsel or the Connecticut Workers’ Compensation Commission directly.

How NCCI Class Codes Apply to Car Wash Operations

The National Council on Compensation Insurance is a data, rating, and advisory organization that helps insurers and regulators classify operations/exposures and track costs associated with workers’ comp claims. Essentially, it provides the data to insurers that show the relative expense of an injury associated with a particular job, so that insurers know how to adjust their costs.

In a car wash operation, employees who wash, vacuum, and detail vehicles are rated under Code 8380. The rate for this code reflects the risk of working on wet floors, chemical exposure, and equipment contact. These risks increase the cost to insure employees under this code.

Mobile car wash operations that send crews to a customer’s lot generally follow the same classification as the washing and detailing staff. The commercial auto exposure for the vehicles hauling equipment is rated separately and should be reviewed alongside the workers’ comp policy.

Administrative Staff Carry a Different Code

Office staff and managers whose work does not require them to be on the wash bay floor may be able to be classified under Code 8810, Clerical Office Employees, which typically carries a lower rate than 8380. NCCI’s clerical exception requires that these employees work exclusively on administrative duties in an area physically separated from the service areas.

Admin stationed at a window that opens directly onto the bay, or one who periodically helps flag cars through the line, may not meet that separation standard. That classification call should be confirmed with your agent rather than assumed at renewal.

How Seasonal Staffing Affects Coverage Obligations

Like full-time staff, seasonal employees also have to be covered by workers’ comp from their first day. There is no exemption tied to how many weeks someone works, how many hours are scheduled, or whether the position is expected to end when demand drops in the fall.

Workers’ comp premiums are commonly based on estimated payroll, and every policy is subject to audit at expiration. A car wash that ramps up seasonal hiring in the spring and underreports those wages defers the cost to the audit, where the carrier assesses additional premium on the unreported payroll, plus interest in some cases on the underpayment.

The Injury Types That Most Often Drive Car Wash Workers’ Comp Claims

Slip-and-fall incidents on wet bay surfaces are the most frequent workers’ comp claims in a car wash, and job codes with frequent claims are more expensive to insure. When the employer satisfies the state’s premium eligibility threshold, Connecticut uses the NCCI’s experience rating model (experience mod) to adjust the costs to insure employees according to the company’s own three-year history of claims (21 months to 57 months).

The NCCI views the cost of any single incident as a matter of chance, and the cost of a single injury can have varying impact on the experience mod. However, the organization presumes that a company with a history of frequent accidents, even if those accidents are relatively minor, has a weak safety program and is likely to continue to have more accidents in the future. Therefore, the frequency of accidents is weighted relatively heavily.

For example, a car wash with several minor slip-and-fall claims in a policy term can see a larger experience mod increase than one with a single expensive claim of the same total dollar value. 

Other common risks that impact the loss profile that carriers underwrite for car wash operations include: 

  • Chemical exposure from the degreasers, tire shine, and detailing chemicals used throughout a shift. Repeated skin or respiratory exposure without proper ventilation or protective equipment is a recurring claim type in the industry.
  • Repetitive strain that shows up in hand detailing roles when an employee performs the same wiping, buffing, or vacuuming motion for hours at a stretch. This can lead to shoulder and wrist injuries that develop over months rather than in a single incident.
  • Equipment-related incidents involve moving parts on conveyors, in-bay automatics, and pressure washing equipment. An employee’s hand, clothing, or hair can catch in a mechanism that was not fully guarded during a maintenance check.

How Multi-Role Employees Are Handled

In many industries, the payroll for workers who perform duties in multiple properly assigned job classifications can be divided among those classifications, provided some rules are met (such as maintaining accurate logs). This can allow companies to divide their payroll into less expensive workers’ comp categories.

However, for a car wash, Code 8380 already includes car wash attendants, brake and muffler repair, tire retreading, and even race car teams. Essentially, 8380 is a broad category for automobile servicing that does not involve major bodywork (which is Code 8393).

If your car wash has staff who only do bookkeeping, payroll, and data-entry type duties; if their workspace is physically separate from the car wash’s operations; and if they do no bay work at all, they may be classified as Code 8810 (Clerical Office Employee). 

However, Code 8810, as well as some other relevant codes including 8871 (Clerical Telecommuter Employees), 8742 (Outside Salespersons or Collectors), and 8748 (Automobile Salespersons), can’t have their payroll divided. 

If a clerical employee spends any time doing work that is exposed to the physical hazards of the car wash (including water spray and chemical exposure), they should be classified as Code 8380.
